Circuit Clerks are elected for a period of six years and their cuties, responsibilities and compensation are set by statute. The Circuit Clerk is an officer within the Judicial System and is the registrar, recorder and custodian of all pleadings and documents in the Circuit and Family Courts. The Clerk is also responsible for the administration and management of the Jury System within their county. The Clerk prepares monthly reports, distributes fees collected to various state and local agencies and submits all statistical reports to the West Virginia Supreme Court of Appeals. Because the Clerk works with all the entities and agencies that comprise the justice system, communication and cooperation are essential. The Circuit Clerk's Office provides procedural assistance and information to pro se litigants. All property is assessed annually as of July 1. Each person's annual tax bill is based upon the condition and ownership of real and personal property as of July 1 of the previous year. For example, your 2015 tax bill was based upon ownership as of July 2014. The 2014 tax bill was based upon ownership on July 1, 2013. The 2013 Tax was based upon ownership as of July 1, 2012. This process can benefit and hurt the taxpayer on occasion. For example, if you purchase a vehicle on July 5, 2015, you will not have to pay taxes on it until you receive the 2017 tax bill (no taxes are due on this vehicle in 2016 since you did not own the car on July 1, 2015!). However if you purchase a home on July 5, 2015, which was classified as rental on July 1st, you will be responsible for the 2016 tax bill as rental property, not an owner-occupied home. This means that the 2016 bill will be twice what you will pay in the following years since the tax rate on the rental property is double the owner-occupied home rate. If there is a mistake on my assessment and I am overcharged on my tax bill, how can it be corrected? In certain instances, an exoneration can be given to the taxpayer so that the amount attributed to the error is refunded to the taxpayer or credited to any outstanding bills. The Assessor's Office will process the necessary paperwork to correct the error which usually takes 2-4 weeks. Exonerations can't be given, however, because you simply think your taxes are too high. A verifiable clerical, computer, classification or data collection error must have occurred to be eligible for an exoneration to be approved. Contact the Assessor's office immediately to determine if an exoneration is warranted. Since the Assessor is elected in West Virginia, can't he/she assess property any way they want? NO, as with all public officials, Assessors, take an oath to obey the laws of the United States and the State of West Virginia. The methods of assessing property are clearly spelled out in the property tax laws and regulations in each county with every Assessor Besides determining property values, what other responsibilities does the Assessor have? In West Virginia, the Assessor has several additional responsibilities. We keep track of ownership changes, maintain maps of parcel boundaries, keep descriptions of building and property characteristics up to date and keep track of exemptions. We also analyze trends in sales prices, construction costs and rents to estimate the value of all assessable property. We are also responsible for collecting fees for dog licenses. As you can see, in order to serve you effectively, we need your cooperation. By submitting timely accurate property returns and providing accurate information to deputies who visit your property, you help us better serve you. I own rental property and a vacant lot, are they taxed differently than the home in which I live? In West Virginia, yes. Remember the goal of the Assessor's Office is to estimate each property's fair, current market value. The assessed value is then multiplied by a tax rate. According to state law, the tax rate for rental and vacant property is twice that for owner occupied property. This means that if your home is assessed for $20,000, taxes on the rental property will be twice the taxes due on the owner occupied home. The method for determining the value of each property is the same, but the tax rate applied to certain classes of property are different. What is the state-mandated property reappraisal? In 1990, the West Virginia Legislature ordered a statewide reappraisal of all property in West Viginia. This was ordered because most property in the state had not been revalued for 20 to 30 years. In other words, similar homes were not being assessed the same. Reappraisal now occurs in three year cycles and the goal is to estimate each property's fair, current marker value- the price your property could sell for on the open market. I believe my assessment is incorrect, what can the Assessor's Office do? There is no greater obligation of an Assessor than to value all property fairly and accurately. In West Virginia, you can ask for a review of your assessment by the Assessor's Office if you believe either one of two things: 1) items that affect the value of your property are listed incorrectly; or 2) the estimated market value is too high and you have evidence that similar properties have sold for less than the market value of your property. Remember, however, that an assessment appeal is not a complaint about higher property taxes. It is an attempt to prove that your property's estimated current market value is not accurate. What happens if the Assessor fails in maintaining property at fair market value? The State Commissioner is required under West Virginia Law to seize our office’s records and to bring the assessments into compliance. I will use all resources at my disposal to ensure that we are in compliance and that these penalties and adverse effects do not occur. The taxpayers of Wetzel County deserve an equal and uniform tax base and we will diligently work to ensure that they have one. Does the Assessor raise your taxes? No. State law requires that the property tax assessments are to be annually updated to the end and that all property is assessed at an equal and uniform 60% of its market value (see WV Code §11-1C-9). The Board of Education, the County Commission, the Municipality, and the West Virginia Legislature set the tax rates or levy rates. Do taxes have to raise? No. Your property tax bill is determined by multiplying a tax rate against your assessed value. The assessed value is 60% of the property's current market value. If property values rise and levy rates are reduced, taxes do not have to rise. Assessed Value x Tax Rate = Tax Bill

The office of the clerk is authorized by Article 8, Section 9 of the West Virginia Constitution. The Circuit Clerk is an officer within the judicial system and plays a pivotal role in that system. The West Virginia Constitution establishes a hierarchy of administrative control that gives overall authority for the entire judicial system to the Supreme Court of Appeals. Local administrative authority lies in the circuit court, including the office of circuit clerk with regard to the clerk’s judicial functions but the clerk has autonomy to establish procedures and policies necessary to carry out statutory responsibilities. The salary range is $42,240 to $55,440 and is required to be full-time in Class I-V counties. Jury Duty Notifications GRAND JURY: The Grand Jury consists of sixteen (16) members and meets the 2nd Tuesday of each term of court (January, April and September). The main duty of the Grand Jury is to hear criminal cases presented by the Prosecuting Attorney and decide if there is probable cause. It is not their duty however, to decide the guilt or innocence of an individual. PETIT JURY: A Petit Jury in criminal cases determines guilt or innocence. A guilty finding must be by unanimous vote. Twelve (12) people are impaneled to sit on a criminal trial. A Petit Jury in civil cases decides between a plaintiff and defendant as to disagreements that have arisen between parties. They must also be unanimous in their decision. Six (6) people are impaneled to sit on a civil trial. Petit Jury duty is for a period of approximately one hundred twenty (120) days. Court generally begins at 9 a.m. and usually lasts until 4:30 or 5 p.m., there may be some instances when juries are in deliberations when it would go past that time. If you are selected to serve as juror you will receive an automated call to the numbers that were listed on you juror qualification form as well as a text message and an email, that will give you the information such as the date and time you need to report as well as the telephone number to call the day before to make sure the trial is still on. The Circuit Clerk is responsible for the administration and management of the Jury System and provides jury panels for Circuit, Magistrate and Municipal Courts. The Clerk creates the master list of prospective jurors, randomly selects panels for attendance, qualifies and summons the jurors and monitors attendance and mileage for reimbursement purposes. The Supreme Court of Appeals of West Virginia states that you have the right to represent yourself in state courts. In fact, many people in West Virginia go to court without a lawyer. Some people cannot afford to hire a lawyer. Others decide that they would rather handle their legal problems on their own. Should I go to court without a lawyer? This is your decision to make. You may request a "Going Solo" booklet in our office that will assist you with representing yourself. How do I file my lawsuit? Is there a form I can use? A lawsuit begins with the filing of a written complaint in the court clerk's office. The Office of the Circuit Court Clerk may have some forms for the circuit court and has many forms for family court cases. You can go to the clerk's office, tell them what your case is about and they will give you the forms to fill out for your type of case. There is a small fee for the forms. Do I have to pay to file a lawsuit? Yes. The court will charge a fee to file your case. In family court cases there is a charge for the forms, but you may not have to pay those fees if you meet low-income guidelines. This is called a fee waiver. If you think you might qualify, ask the clerk to give you the Fee Waiver Forms to see if you are eligible to have the fees waived. This form and many other forms are available on the Supreme Court's web site at http://state.wv.us/wvsca, or ask at your circuit court clerk's office. How do I make sure I've done everything right? The courthouse staff can not give you legal advice about your specific case, but they will answer your questions about how the court system works. If you decide that there is too much at stake or your case is too difficult to handle on your own, you can always contact and hire a lawyer. Q: Why did my house number change? A: First and foremost – for public safety reasons. The USPS is phasing out its use of HC and RR style addresses and adopting the physical style address system. When there are problems with an existing city-style address that could create confusion for emergency responders, the structure in question will be readdressed. Q: Why was my road named? A: If a shared driveway meets the criteria as outlined by county ordinance, then it will be named and the homes accessed from it will be addressed off the new road. Q: Why is there such a large gap in between my house number and my next-door neighbor’s? A: Newly addressed roads are assigned numbers using a 5.28 foot interval system, which allows for 1,000 addresses per mile (500 odd numbers & 500 even numbers). This interval system provides a means for emergency responders to quickly calculate the location of an emergency caller. Q: How does the new address affect my mail? A: If you receive home delivery, you will have approximately one year to update all correspondence to the new address. If you have a PO Box, your mail will not be affected. Q: Do I have to pay for a new Driver’s License or Registration? A: No. Residents are not required to get a new license, but they are required to notify the DMV of their change of address. This can be done, at no cost to the resident, by completing the WV DMV’s Change of Address Form. This will update all driver’s licenses, titles, registrations and handicap placards in the DMV system and can be done in person at a local DMV branch or via mail.
